Variances

Sometimes in developing a project an applicant may find that they can not meet some development standard because of unique or special condition that effects their property. For these types of situations a Variance application can be submitted and with the project and then the Planning Commission or City Council would take final action depending on the type of project. It is important to remember that a variance is for a development standards such as setback, area, or height and may not be used to obtain a particular use on a property. To change a use one must apply for an Ordinance Text Amendment or Zone Change. In order to approve a variance there are four findings that must be made and they are the following:

  1. That there are exceptional or extraordinary circumstances or conditions applicable to the property or the intended use that do not apply generally to other properties or uses in the same vicinity and zone.

  2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone district, but which is denied to the property in question.

  3. That the granting of the variance will not be detrimental to the public welfare or injurious to the property or improvements of others in the vicinity.

  4. That the granting of the variance will not adversely effect the General Plan of the City of Redlands.

In order to obtain approval the City Council or Planning Commission must make all four findings. Please take the time and discuss your application with staff to insure that all the findings can be made. Any staff member would be more than happy to review your application with you. Most of the time a Variance application is linked to another application, however in some instances it may be a stand alone application. Depending on what kind of project it is linked to would determine if it needs Environmental Review or if the final acting body would be the Planning Commission or City Council.
